REFEREE / SPECIAL MASTER


WHO IS A REFEREE/SPECIAL MASTER?

Occasionally the parties or the trial court will retain a neutral to perform the role of a referee (Code of Civil Procedure §§ 638, 639) or a special master (e.g. Penal Code § 1524)). Examples include appointing a referee to oversee an election and the counting of votes, or to act as a discovery referee. When the referee is appointed by agreement of the parties, the referee’s decision becomes the decision of the court. In all other references, the referee’s decision is only advisory. (CCP § 644.)
